By downloading, installing, or using MediGuard Companion ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, including the Medical Disclaimer, do not use the App.

2. Description of Service

MediGuard Companion is an iOS application that provides:

• Medication tracking and reminder tools
• Health metrics logging (blood pressure, glucose, weight, heart rate)
• Aily adherence tracking
• AI-powered educational health suggestions (Premium feature)
• Accessibility features for seniors
• Health report generation (Premium feature)

3. MEDICAL DISCLAIMER

NOT A MEDICAL DEVICE:

• MediGuard Companion is for informational and organizational purposes only
• It is NOT a medical device, medical app, or diagnostic tool
• It does NOT provide medical advice, diagnosis, or treatment
• It is NOT a substitute for professional medical care
• Medication reminders are organizational tools, not medical recommendations

ALWAYS CONSULT HEALTHCARE PROFESSIONALS:

• Consult your doctor before starting, stopping, or changing any medication
• Consult your doctor about proper dosages and schedules
• Consult your doctor if you experience any adverse effects
• Never make medical decisions based solely on app suggestions

AI ASSISTANT DISCLAIMER:

• AI-generated suggestions are educational only, NOT medical advice
• AI responses may contain errors or inaccuracies
• AI cannot diagnose conditions or recommend treatments
• AI cannot replace consultation with qualified healthcare professionals
• All AI responses include safety disclaimers

EMERGENCY SITUATIONS:

• DO NOT use this app in emergency situations
• Call emergency services (911 in US, 112 in Europe) for medical emergencies
• Do not delay emergency care to input data into the app

4. License

Subject to your compliance with these Terms and the Medical Disclaimer, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal health organization purposes.

You may not:

• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer, sublicense, or resell the App
• Use the App for any illegal or medical treatment purposes
• Use the App as a substitute for professional medical care

5. Subscription Terms

Free Plan:

• Basic medication tracking and reminders
• Daily check-in
• Health metrics logging
• Accessibility features
• No payment required, can be used indefinitely

Premium Plan ($/€1.99/month):

• All free features
• AI health assistant (educational suggestions only)
• AI medication explanations (educational only)
• Advanced health insights
• PDF health report export
• Caregiver summary generation
• Automatically renews monthly unless cancelled
• Charged through your Apple ID account
• Payment charged at confirmation of purchase
• Special intro offer: First 3 months at $0.99/month for new subscribers
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions may be managed and auto-renewal may be turned off in Account Settings after purchase
• No refunds for the current subscription period

6. Payment and Refunds

All payments are processed by Apple through the App Store. Refund requests must be directed to Apple in accordance with their refund policy. We do not have access to or control over Apple's payment processing.

7. User Responsibilities

You are solely responsible for:

• Accurately entering medication information, dosages, and schedules
• Verifying all information with your healthcare provider
• Taking medications as prescribed by your doctor (not as suggested by the app)
• Monitoring your health and reporting concerns to your doctor
• Keeping the app updated with current medication changes
• Backing up your health data
• Not relying solely on app reminders for critical medications
• Maintaining your own medication records outside the app

8. Accuracy and Reliability

NO WARRANTY OF ACCURACY:

• We do not guarantee the accuracy of AI-generated suggestions
• Reminders may fail due to device settings, battery, or technical issues
• You must maintain backup reminder systems for critical medications
• Health tracking features are informational tools, not diagnostic devices

9. Acceptable Use

You agree not to use the App to:

• Self-diagnose or self-treat medical conditions
• Replace professional medical advice or consultations
• Make medication decisions without consulting healthcare providers
• Share medical advice with others based on app suggestions
• Use the app on behalf of others without proper authorization
• Violate any applicable health information laws

10. Privacy and Health Data

Your use of the App is governed by our Privacy Policy. Key points:

• All health data is stored locally on your device
• AI features (Premium) send only anonymized queries to AI providers
• We do not store your medications or health records on our servers
• You can disable AI features at any time

11. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for medical purposes
• Accuracy of medication reminders or AI suggestions
• Error-free or uninterrupted operation
• Suitability for your specific health needs
• Medical accuracy or reliability

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any health complications, injuries, or adverse events
• Missed medication doses due to failed reminders
• Incorrect medication information entered by users
• Inaccurate AI suggestions or explanations
• Loss of health data
• Medical decisions made based on app information
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of health, life, or medical injury

Our total liability shall not exceed the amount you paid for the subscription in the past 12 months, or €10, whichever is greater.

HEALTH-RELATED LIMITATION: We are not responsible for any health outcomes, medication errors, or medical complications arising from use of the App. You assume all risks associated with managing your health using the App.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Any health decisions you make based on app information
• Incorrect information you enter into the App
• Your failure to consult healthcare professionals
• Your violation of these Terms

14. Data Backup

You are solely responsible for backing up your health data. We recommend:

• Enabling iCloud backup on your device
• Regularly exporting health reports (Premium feature)
• Maintaining paper or other records of critical medications
• Keeping backup reminder systems for essential medications

We are not responsible for any data loss.

15. Third-Party Services

The App integrates with:

• Apple Services: StoreKit (subscriptions), Notifications, Speech
• Groq AI: For AI health assistant features (Premium)
• OpenAI: Fallback AI provider (Premium)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service functionality or availability.

16. Updates and Changes

We may:

• Update the App with new features or bug fixes
• Modify or discontinue features
• Change subscription pricing with 30 days notice to existing subscribers
• Update medical disclaimers and safety features

Continued use of the App after updates constitutes acceptance of changes.

17. Termination

By You: You may stop using the App at any time by uninstalling it. Cancel subscriptions through your Apple ID settings.

By Us: We may terminate or suspend your access if you violate these Terms or use the App in a manner that endangers health or safety.

18. Age Restrictions

You must be at least 13 years old to use the App. The App is designed for adults managing their own medications. If you are under 18, you must have parental consent. Caregivers may use the App to help others manage medications with proper authorization.

19. Geographic Restrictions

The App is available worldwide where the Apple App Store operates. You are responsible for complying with local laws regarding health apps and data privacy.

20. Dispute Resolution

Any disputes arising from these Terms or use of the App shall be resolved through:

• Good faith negotiation between parties
• If unresolved, binding arbitration in accordance with applicable laws

21. Governing Law

These Terms are governed by the laws of the European Union and Italy, without regard to conflict of law provisions.

22. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

23. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and us regarding the App.

24. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Posting a notice in the App
• For significant changes, requiring acceptance before continued use

26. Apple Requirements

This App is distributed through the Apple App Store and subject to Apple's standard End User License Agreement (EULA). In case of conflict between these Terms and Apple's EULA, Apple's EULA shall prevail.

27. Final Acknowledgment

BY USING MEDIGUARD COMPANION, YOU ACKNOWLEDGE THAT:

• You have read and understood these Terms and the Medical Disclaimer
• You understand this is NOT a medical device or medical advice tool
• You will consult healthcare professionals for all medical decisions
• You assume all risks associated with medication management
• You will not rely solely on the App for critical health management
• You understand AI suggestions are educational only and may contain errors
