1. Acceptance of Terms

By downloading, installing, or using MailPix Organizer ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

MailPix Organizer is an iOS application that provides:

Photo organization and management tools
Image editing capabilities
Contact (person) information storage
Email template creation and management
Email composition and sending via iOS Mail

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or commercial purposes.

You may not:

Reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices
Transfer, sublicense, or resell the App
Use the App for any illegal purposes

4. Subscription Terms

Free Plan:

Access to basic features with limitations (2 photos, 1 folder, 2 persons)
No payment required
Can be used indefinitely

Premium Plan ($/€1.99/month):

Unlimited photos, documents, folders, and persons
All features unlocked
Automatically renews monthly unless cancelled
Charged through your Apple ID account
Payment charged at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Account will be charged for renewal within 24 hours prior to the end of the current period
Subscriptions may be managed and auto-renewal may be turned off in Account Settings after purchase
No refunds for the current subscription period

5. Payment and Refunds

All payments are processed by Apple through the App Store. Refund requests must be directed to Apple in accordance with their refund policy. We do not have access to or control over Apple's payment processing.

6. User Content

Ownership: You retain all rights to photos, contact information, and other content you create or import into the App.

Responsibility: You are solely responsible for:

The content you store and share
Ensuring you have rights to use photos
Complying with applicable laws when using the App
Emails sent using the App

7. Acceptable Use

You agree not to use the App to:

Store or share illegal, offensive, or harmful content
Violate any intellectual property rights
Send spam or unsolicited emails
Harass, threaten, or harm others
Violate any applicable laws or regulations

8. Privacy

Your use of the App is also governed by our Privacy Policy. All data is stored locally on your device. We do not collect, store, or have access to your photos or personal information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Error-free or uninterrupted operation

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of data, photos, or content
Loss of profits or revenue
Damages arising from use or inability to use the App

Our total liability shall not exceed the amount you paid for the subscription in the past 12 months, or €10, whichever is greater.

11. Data Backup

You are solely responsible for backing up your data. We recommend:

Enabling iCloud backup on your device
Regularly exporting important photos
Keeping copies of important data elsewhere

We are not responsible for any data loss.

12. Third-Party Services

The App integrates with Apple services (Photos, Camera, Mail, StoreKit). Your use of these services is subject to Apple's terms and conditions.

13. Updates and Changes

We may:

Update the App with new features or bug fixes
Modify or discontinue features
Change subscription pricing with 30 days notice to existing subscribers

Continued use of the App after updates constitutes acceptance of changes.

14. Termination

By You: You may stop using the App at any time by uninstalling it. Cancel subscriptions through your Apple ID settings.

By Us: We may terminate or suspend your access if you violate these Terms.

15. Intellectual Property

The App, including its design, code, features, and documentation, is owned by us and protected by copyright and other intellectual property laws. MailPix Organizer and its logo are our trademarks.

16. Age Restrictions

You must be at least 13 years old to use the App. If you are under 18, you must have parental consent.

17. Geographic Restrictions

The App is available worldwide where the Apple App Store operates, subject to local laws and regulations.

18. Dispute Resolution

Any disputes arising from these Terms or use of the App shall be resolved through:

Good faith negotiation between parties
If unresolved, binding arbitration in accordance with applicable laws

19. Governing Law

These Terms are governed by the laws of the European Union and Italy, without regard to conflict of law provisions.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

22. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Updating the "Last Updated" date
Posting a notice in the App
For significant changes, requiring acceptance before continued use

24. Apple Requirements

This App is distributed through the Apple App Store and subject to Apple's standard End User License Agreement (EULA). In case of conflict between these Terms and Apple's EULA, Apple's EULA shall prevail.

By using MailPix Organizer, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
